Terms & Conditions
1. Orders are accepted and indications for delivery given conditionally upon our being able to secure the necessary materiel, and without responsibility for delays arising through risks and uncertainties of manufacture, strikes, accidents or other causes beyond our control.
2. Countermands. The right to refuse countermands is reserved in the case of goods despatched or in the process of manufacture.
3. Deposits. When customers order tiles which must, in turn, be specially ordered by us from manufacturers or importers, a deposit of up to 50% will normally be required. Where a customer subsequently cancels such an order, all or part of his deposit may be retained by us to defray our resulting costs, without prejudice to our right to claim from him a further sum where the full deposit does not cover our total costs.
4. Tiles returned. Goods cannot be supplied on Sale or Return Conditions. In general, goods specially ordered from our suppliers cannot be accepted back. Where return of tiles is exceptionally agreed to by us, a credit note, less a minimum rehandling charge of 25%, may be issued at the Company's discretion.
5. Surplus goods. Surplus goods cannot be returned. If in exceptional cases we accept items back the customer will be required to forfeit a rehandling charge of 25% of the value of the tiles or £50, whichever is the greater.
6. Tiles allegedly defective. Shade variations and crazing are inherent qualities within & between different production batches in ceramic tiles. Where such variations and/or crazing are deemed to be excessive the complaint must be notified in writing within 7 days of despatch and before fixing takes place. The company cannot undertake to match the shade of previous orders.
Many of the tiles sold from CRITERION#2 TILES are priced and sold well below their normal value for a variety of reasons and so may be subject to minor faults and imperfections. Specifically they will vary (and be indicated where appropriate) but may include:
(a) slight irregularity of surface glaze or texture; a frequent symptom of Run of Kiln production.
(b) shade or tone inconsistency in glaze or print colour either within one batch, or between batches
(c) slight under-glaze chipping at corners or edges; irregularity of shape.
(d) restrictions on availability beyond current stocks.
7. The customer should inspect and ensure that the quality and quantity of tiles ordered and delivered is satisfactory & acceptable; and should notify us within 7 days from delivery or collection of any discrepancy or error. No claims will be entertained once tiles are fixed. It is advisable always to select tiles from different boxes to ensure an even mix of variation.
8. Our liability in the case of a valid claim for defective tiles is restricted to either their full original purchase price or their replacement with other tiles of the same value, plus the cost of transport to site. In no circumstances will the cost of labour or any other consequential cost be reimbursed. (NB Attention is drawn to Condition No. 7 above.)
9. All due care and attention is given to ensuring that technical information and quantitative advice is accurate, but the Company does not warrant the accuracy thereof and the customer's reliance on it is at his own risk.
10. Any description of goods by the Company or its suppliers is given by way of identification only and its use of such description shall not constitute a sale by description. The Company cannot be held responsible for any failure in suitability of goods for a specific installation unless the manufacturer, in a published brochure, leaflet or notice describing the goods, has recommended their suitability for that specific purpose without qualification.
11. The Company does not undertake to deliver. Any delivery may be subject to surcharge and restrictions of insurance liability as borne by the Company.
12. The risk in the goods shall pass to the customer on despatch from our premises in accordance with these conditions, but the property in the goods shall not pass to the customer until full payment is made.
13. All prices are subject to alteration without notice and are subject to VAT at the current rate.
